1. Acceptance of Terms

By accessing or using DentAI ("the Service"), operated by DentAI SA, Geneva, Switzerland, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

DentAI provides AI-powered dental visualization tools that allow dental professionals to generate smile transformation previews for patient consultation purposes. The Service includes:

• AI smile transformation tool (image generation)
• Motion preview tool (short AI-generated videos animating a photo)
• Before/after image comparison
• A library of ready-to-use prompts for dental practices
• Transformation history and management
• Educational newsletter content

AI processing transparency: generations are produced by third-party AI models (currently Google image-editing models and the Kling video model, accessed through the fal.ai platform). Your uploaded photo and instructions are transmitted to these providers solely to produce your result, as described in our Privacy Policy. We may change the underlying models to improve quality.

The Service is currently free and usage is limited by a monthly credit system. Credit amounts and limits may change at any time.

3. User Responsibilities

Consent Requirement:

You must obtain proper consent from any individual before uploading their photo to our Service. You are solely responsible for ensuring you have the legal right to use any image you upload.

Professional Use:

The Service is intended for dental professionals as a communication aid during patient consultations. It is not intended for entertainment or consumer use.

Appropriate Use:

You agree NOT to:

• Upload photos without the subject's consent
• Use the Service for any illegal or unauthorized purpose
• Upload inappropriate, offensive, or harmful content
• Use generated images or videos to impersonate a person, create misleading "deepfake" content, or present an AI-generated result as a real, unedited photograph or video of a person
• Present a generated preview to a patient as a guaranteed treatment outcome
• Attempt to reverse engineer or exploit the Service
• Share your account credentials with others
• Use the Service to mislead or deceive patients

4. Important Disclaimers

Results — both images and motion-preview videos — are AI-generated simulations and may not accurately reflect what is achievable through actual dental procedures. Always provide patients with realistic expectations and professional medical advice.

When showing or sharing a generated image or video with a patient, you should make clear that it is an AI-generated visualization, not a photograph or a guaranteed result.

5. Account Terms

• You must provide accurate information when creating an account
• You are responsible for maintaining the security of your account
• You must be at least 18 years old to use the Service
• One person may not maintain multiple accounts
• We reserve the right to suspend or terminate accounts that violate these terms

6. Intellectual Property

Our Content:

The Service, including its design, features, and AI technology, is owned by DentAI and protected by intellectual property laws.

Your Content:

You retain ownership of the photos you upload. By using the Service, you grant us a limited license to process your images solely for the purpose of providing the transformation service. We do not claim ownership of your photos or use them for any other purpose without your consent.

Generated Images and Videos:

AI-generated transformation images and motion-preview videos are provided for your use in patient consultations. You may download and share them with the patient concerned as part of your dental practice, subject to the Appropriate Use rules above.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DENTAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits or revenue
• Loss of data
• Patient complaints or disputes arising from AI-generated images
• Any damages resulting from unauthorized access to your account

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DentAI from any claims, damages, or expenses arising from your use of the Service, including claims related to photos uploaded without proper consent.

11. Termination

You may terminate your account at any time by contacting us or using the account deletion feature. We may terminate or suspend your account if you violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or through the Service.

13. Governing Law

These Terms shall be governed by and construed in accordance with Swiss law, without regard to conflict of law principles. The exclusive place of jurisdiction is Geneva, Switzerland, subject to mandatory consumer protection rules in your country of residence.
